    Current Law Summary: (HB 289, KRS 41.250, KY Acts 123) Construction professionals are not liable for acts or omissions of a person other than const professional or his agent, employee or subcontractor; failure of others to take reasonable action to reduce the damages or maintain the residence; normal wear, tear, or deterioration; normal shrinkage, swelling, expansion, or settlement; construction defect disclosed to claimant before purchase.

    Parking Garage Partially Collapses in Dearborn, Mich., Trapping One

    A multi-level parking garage that partially collapsed in Dearborn, Mich., is fenced off and the city has started the legal process allowed under state law to demolish the privately-owned structure due to alleged dangerous conditions. Read the full story...

    Additional Insureds Owed a Defense in Underlying Personal Injury Suit

    March 03, 2026 —
    The court granted partial summary judgment on the duty to defend to two additional insureds who were named as defendants in the underlying personal injury suit. In re Third St. Equity, LLC, 2025 U.S. Dist. LEXIS 234909 (E.D. N. Y. Dec. 2, 2025). Third Street Equity LLD hired Developing NY State, LLC as the contractor for a construction project. Developing NY entered a subcontract agreement with Capital Source Concrete NY LLC for concrete work as well as labor and services for a construction project. The subcontract required that Capital Concrete keep the construction site free of debris, waste material or rubbish. Further, Capital Concrete was responsible for compliance with OSHA safety regulations. It was also agreed that Capital Concrete would obtain liability and workers compensation insurance naming Third Street and Developing NY as additional insureds. Read the full story...

    Weather Delay Claim - Owner Delay Pushes Contractor into Worse Seasonal Adverse Weather

    November 04, 2025 —
    In government contracting, a contractor is entitled to a time extension for “unusually severe weather.” However, this time extension is typically not compensable (meaning you get time, but not additional compensation). However, “a contractor may bring a claim for compensable delay when government delay pushes a contractor’s performance into a period of worse seasonal adverse-but not unusually severe-weather.” Appeals of - Thalle Construction Company, ASBCA No. 63685, 2025 WL 2496328, n.10 (ASBCA 2025) (citation omitted). In a recent appeal with the Armed Services Board of Contract Appeals, a contractor pursued a weather delay claim. The contractor sought 39 days of adverse weather between the adjusted contract completion date and the actual substantial completion date claiming that the government pushed the contractor’s last 262 days of performance into worse seasonal adverse weather.     Employer’s Liability Exclusion Bars Coverage

    November 18, 2025 —
    The court held the policy’s Employer’s Liability Exclusion precluded coverage for the injured individual who was deemed to be an employee of the insured. Craft v. Access L.L.C., 2025 U.S. Dist. LEXIS 179794 (W.D. La. Sept. 2, 2025). Charles Craft worked for FL Crane & Sons, Inc.. The general contractor of the project, Lemoine Company, LLC, hired FL Crane to do work on the project. Lemoine rented a crane from Morrow Equipment Company, LLC, and hired a crane operator from Skyhook Ops, LLC. Burlington was Skyhook’s insurer. Craft claimed his left arm was injured while working atop a scaffolding when Skyhook caused the scaffolding system to be pulled apart when operating a crane. Read the full story...

    The proper use of professional seals in North Carolina is critical. Failure to follow the prescribed requirements can subject you or your Firm to a Board sanction. Did you know that the NC Board of Architecture and the NC Engineering Board have jointly prepared a fairly straightforward document that can tell you exactly what you need to know about sealing of plans? That document, the “Seal Brochure” (pdf) is available for download. Every state’s regulations are a little different (thank you Federalism!) so it is worth reviewing with your staff at regular intervals, especially if you do work across state lines.
