    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Texas Legislative Update: Breaking Down the New Texas Laws Impacting Construction

    September 03, 2025 —
    The Texas Legislature concluded its Regular Session and quickly moved into a Special Session. While political gridlock may dominate headlines at the State Capitol, lawmakers enacted legislation with significant implications for the construction sector. This update highlights the most important legislative developments from the 89th Regular Legislative Session. The 89th Regular Session convened from January 14th through June 2, 2025, producing several legislative reforms affecting the construction industry. Of 11,277 bills filed, the Legislature enacted 1,155 measures, with Governor Abbott vetoing 28 bills by the June 22, 2025 deadline. Although the Legislature has since entered Special Sessions, no agenda items currently under consideration are expected to directly impact the construction industry. The following sections review key legislation from the Regular Session, focusing on those bills most relevant to the construction industry. Topics include restrictions on new rules on right to repair accrual dates, prompt payment requirements for public works projects, changes to trust fund assignment rights, lien law deadline reforms, venue provisions for construction contracts, contracting integrity in K-12 and higher education, expanded liability protections for land surveyors, municipal regulation of mixed-use and multifamily projects, bonding limitations on pipelines, updated building energy codes, LNG permitting reforms, and environmental standards for construction materials facilities.     At the Border of Contract and Torts in Construction Disputes

    August 25, 2025 —
    "The declining significance of privity has found its way to construction law." So begins the 4th District Court of Appeal’s decision in Lynch v. Peter & Associates, Engineers, Geologists, Surveyors, Inc., 104 Cal.App.5th 1181 (2024). The case addresses the legal duty of care owed by construction professionals - specifically geotechnical consultants - to property owners with whom they are not contractual privity. The case reaffirms the Biakanja factors and signals the growing willingness of courts to impose liability beyond contract boundaries, especially in residential construction. Factual Background In April 2018, general contractor Grover Construction (Grover) hired geotechnical firm Peter & Associates, Engineers, Geologists, Surveyors, Inc. (“Peter”) to perform a limited inspection of a footing trench for a proposed addition to a single-family home in San Clemente, California owned by Gregory and Cheryl Lynch. The Peter firm’s scope was narrow and its fee modest - just $360. Read the full story...

    Anatomy of an Insurance Dispute

    In early 2025, we participated in a panel discussion about the similarities and differences in the process of resolving a disputed insurance claim. We were both so taken by the striking differences in the process and had such a good time learning about each other’s process that we decided to prepare this joint article to share with a wider audience. Comparatively examining the anatomy of an insurance dispute in the US and the UK is an exercise in contrasts. In many ways, the two are strikingly opposite. Here, we examine, from start to finish, how the process differs in the two jurisdictions and how those differences may contribute to different outcomes, and discuss what lessons perhaps can be gleaned from each other’s experience.     What Everyone Needs to Know About Schedule Float

    August 18, 2025 —
    Scheduling for a contractor is essential and helps contractors organize work, manage subcontractors, and avoid costly delays. An accurate schedule helps a contractor to keep a project on track, meet deadlines and assist in preventing conflicts between different subcontractors working on a project. In short, construction scheduling is a key tool for completing projects efficiently and successfully. There are different types of schedules including bar charts (Gantt charts), critical path method (CPM) schedules, look-ahead schedules, and linear scheduling for repetitive tasks. Each type serves a different purpose, from providing high-level overviews to detailed task sequencing and daily or weekly planning. CPM schedules are very common and often considered the best type of schedule because they not only illustrate the sequence of activities but also identify the critical path, helping contractors prioritize tasks, manage delays, and keep the project on time. A CPM schedule also highlights where there is flexibility or potential risk. Read the full story...

    Backpacks, Broadway, and Building Restrictions: A Legal Reminder

    September 15, 2025 —
    A few weeks ago, I took two of my girls to New York City for a quick overnight trip to see two Broadway shows. My rule for packing was simple: one backpack each. No rolling bags, no extras. We were walking the city, checking into a hotel, and going straight to the shows. The plain meaning of my instructions were clear: one bag per person. That’s exactly how the Tennessee Court of Appeals handled a recent case, Killen v. Boardman (Aug. 2025). A landowner tried to build a second house after subdividing her lot. But the subdivision restrictions, recorded in 1971, said: "Not more than one residence shall be erected on one tract." The court enforced the restriction as written. One tract meant one residence. Splitting the lot didn’t erase the covenant or the developer’s plan for the subdivision. What made the analysis significant was the court’s reliance on the general plan doctrine, which holds that that when developer sells land with restrictions designed to implement a general plan of development, he “impliedly represents to the purchasers that the rest of the land included in the plan is, or will be, similarly restricted.” Read the full story...

    Construction Estimation: From Manual Takeoff to the AI Future

    August 25, 2025 —
    Quantity takeoff (QTO) is the foundation of construction cost estimation, another critical task. For decades, professionals have sought to streamline QTO through technology, aiming for greater speed, consistency, and accuracy. Yet despite advances in digital tools, the profession is still in flux. A 2023 global study by RICS and Glodon found that only 39% of surveyed organizations use QTO and estimating software integrated with BIM or Common Data Environments. Another 31% rely on standalone tools, and 30% still don’t use specialized software at all. As someone who’s witnessed the evolution of QTO technologies since the 1980s, from digitizing tablets to today’s AI-powered platforms, I find this gap telling. Now that machine learning and large language models are entering the mix, the big question is: Will AI finally automate the estimation process or just become another tool in the estimator’s kit?
