California Supreme Court Approves of Annual Civility Oath for Attorneys, Rejects Incivility As Basis for Disciplinary Measures

San Diego, Calif. (October 20, 2025) - Courts and lawmakers in California and across the country are continuing to grapple with the ongoing problem of incivility among lawyers. Nearly every week a new story is publicized in which an attorney is sanctioned or rebuked for sharp rhetoric in filings or combative behavior in the courtroom. The erosion of courtesy threatens not only collegiality but also the fair administration of justice. On July 20, 2023, the State Bar of California Board of Trustees made an effort to restore respect and decorum within the practice of law within the Golden State. It approved and sent proposed measures to improve the civility of attorneys in California to the California Supreme Court for review and approval. The proposed measures included: (1) changes to California Rule of Court 9.7 that would require attorneys to reaffirm their oath of civility annually; and, (2) amendments to the Rules of Professional Conduct that would add acts of incivility as a basis for disciplinary measures against attorneys. Sacramento Team Obtains Defense Verdict for Motel Client in Unruh Act Lawsuit over Trip-and-Fall Incident

Sacramento, Calif. (September 24, 2025) - Sacramento Partner Shane Singh and Associate Grace Mehta of Lewis Brisbois’ Labor & Employment and ADA Compliance & Defense Practices recently secured a defense verdict for a motel client following a three-week trial in an Unruh Act lawsuit arising from a trip-and-fall incident in 2019. The incident in question occurred in August 2019 at the client's motel in Barstow, California. The plaintiff, an elderly woman, had alleged she booked an accessible room at the motel through an online service. Upon arrival at the motel, the motel did not have a record of the accessible room request and the only ADA accessible room at this motel was already occupied. Additionally, the accessible room had one bed and plaintiff's party desired two beds. The motel allowed the party to examine a room on the first floor with two beds. The plaintiff and her party examined the room and then accepted it for their one-night stay. Read the full story...

California Court Affirms $1.8 Million Judgment Against HOA for Failing to Investigate and Remediate Water Intrusion

When an HOA ignores its duties under its covenants and restrictions, the consequences can be devastating. In Ridley v. Rancho Palma Grande Homeowners Association (Cal. Ct. App., Aug. 28, 2025, No. H052560), a Santa Clara couple secured a $1.8 million judgment after their condominium was rendered uninhabitable due to water intrusion, mold, and a sinkhole caused by an abandoned well beneath the property. The Court of Appeal upheld the judgment, finding that the HOA’s delay, deception, and failure to act breached its duties under the CC&Rs. What Went Wrong at Rancho Palma Grande HOA Retirees Doug Ridley and Sherry Shen owned a condominium in Santa Clara County. In 2018, their tenants discovered persistent water pooling in the crawlspace beneath the unit - part of the building’s common area under the HOA’s control. The issue worsened over time, culminating in severe water damage, mold growth, and ultimately, a sinkhole beneath the living room floor. Read the full story...
